Terms of service.
By creating an account, briefing a flyer, or paying a subscription invoice you (the "Subscriber") agree to these Terms of Service. The service is operated by 99agency (Família Assis Holding) under the brand "FLYRKIT". These terms work alongside the Privacy Policy and Cookie Policy. Both documents form a single agreement. This is a placeholder draft pending legal review. Do not deploy commercially without your jurisdiction's counsel signing off on the final text.
01 · The service
FLYRKIT is a productized studio service that delivers print-ready and motion flyers to nightclub operators, promoters, and event venues on a monthly subscription basis. Output is shipped in formats listed on the public pricing page and tied to the tier the Subscriber currently holds.
02 · Subscription & billing
- Subscriptions auto-renew on the cycle date displayed in the portal until cancelled.
- Cancellation is self-service from the FK.PORTAL billing screen. Cancellation takes effect at the end of the current paid cycle. No pro-rated refunds.
- First-cycle 7-day money-back guarantee applies once per Subscriber, requested via email from the account email.
- Pricing is shown in USD, BRL, EUR, MXN. Currency may be revised with 30 days' notice; existing cycles are honored at the current price.
- Failed payments trigger a 7-day retry window. After day 7 the account is suspended and brief production is paused. Library access remains available read-only for 12 months.
03 · Quota & usage
Each tier carries a monthly quota of flyer deliveries detailed at flyrkit.com/#pricing. Unused quota does not roll over. Cancellations of briefs in the brief_pending status return quota; cancellations of briefs already in production do not.
04 · Ownership & license
Once a flyer is approved and delivered, the Subscriber receives a perpetual, worldwide, royalty-free license to use the artifact across all channels for their venue or event. Source SVG files transfer with delivery. Fonts and stock used inside the artifact remain licensed under the agreement FLYRKIT holds with the underlying providers; we will not pursue claims for normal commercial usage. The FK.ID and the optional magenta marker bar remain visual signatures of the FLYRKIT-shipped artifact and may be removed by the Subscriber at their discretion.
05 · Subscriber responsibilities
- Provide accurate brief information; FLYRKIT is not liable for misprints driven by misspelled venue names, wrong dates, or wrong artist credits supplied in the brief.
- Hold the rights to any logo, photo, or asset uploaded as a reference.
- Respect local advertising rules around age-gated venues, alcohol promotion, and depicted artists.
- Do not request flyers promoting illegal activity, hate speech, or content that violates the Acceptable Use rules below.
06 · Acceptable use
FLYRKIT will not produce flyers that promote: child endangerment, real-world violence, organized crime, terrorist activity, hate or discrimination targeting protected classes, or that infringe on third-party intellectual property. We reserve the right to refuse a brief and refund the corresponding quota if the request crosses these lines.
07 · Service-level commitment
Delivery SLA is documented per tier on the public pricing page. Headliner and Mainstage carry a 24-hour SLA; Resident a 48-hour SLA. If FLYRKIT misses the SLA for reasons attributable to our internal operation (not a missing or incomplete Subscriber brief), the next equivalent flyer is delivered at no additional quota cost.
08 · Confidentiality
Briefs, brand kits, and unreleased event details are treated as confidential and accessible only to the FLYRKIT operations team that needs them to execute the job. We do not feature Subscriber work in marketing without prior approval. Aggregated, anonymized metrics may be shared (e.g., "98% on-time delivery") without naming any specific Subscriber.
09 · Disclaimers & liability cap
Within the limits permitted by applicable law, FLYRKIT is provided "as-is". Aggregate liability for any claim is capped at the amount the Subscriber paid in the 3 months preceding the claim. We are not liable for indirect or consequential damages, including lost ticket revenue.
10 · Governing law & disputes
These Terms are governed by the laws of Brazil for Subscribers billed in BRL, by Spain for Subscribers billed in EUR, and by the State of Delaware (United States) for Subscribers billed in USD or MXN. Disputes are resolved first by good-faith negotiation, then by binding arbitration in the venue corresponding to the billing currency. Consumer protection rights in the Subscriber's jurisdiction are not waived.
11 · Changes
FLYRKIT may update these Terms by posting a new version at flyrkit.com/terms and notifying Subscribers via portal banner and email at least 30 days before the new version takes effect. Continued use of the service after that date constitutes acceptance.
